By accessing, browsing, using this Website or purchasing products from Kinnder, you agree to be bound by these Terms & Conditions, our Privacy Policy, and any other policies referenced on our Website.

If you do not agree with these Terms, please discontinue use of the Website immediately.

This Website is owned and operated by By Birdie Pty Ltd, trading as Kinnder (“Kinnder”, “we”, “us”, “our”).

These Terms apply to all users of this Website, including customers, browsers, and purchasers.

2. CHANGES TO THESE TERMS

We reserve the right to update, change or replace any part of these Terms & Conditions at any time.

Any updates will take effect immediately once published on our Website. You agree it is your responsibility to review these Terms regularly.

3. WEBSITE USE

By using this Website, you agree that you will not:

  • misuse the Website or attempt to interfere with its functionality;

  • use the Website for unlawful purposes;

  • attempt to gain unauthorised access to the Website or its systems.

We reserve the right to suspend or terminate your access to the Website at any time if we believe you have breached these Terms.

4. INTELLECTUAL PROPERTY

All content on this Website, including but not limited to designs, product imagery, logos, graphics, text, layouts, and branding, is owned by or licensed to Kinnder.

You may not copy, reproduce, distribute, publish, download, transmit, modify or exploit any part of this Website for commercial purposes without our written permission.

You may download material only for the sole purpose of placing an order through our Website.

You may not create links to our Website from another website without written consent.

5. PRIVACY

It is a condition of using our Website that you have read and consented to our Privacy Policy, which outlines how we collect and use your personal information.

6. PRODUCT INFORMATION

We make every effort to ensure product descriptions, pricing, photos and details are accurate. However, we do not warrant that product descriptions or content is error-free.

Colours and appearance of products may vary depending on lighting, photography, device display settings, and manufacturing variations.

7. PERSONALISATION (EMBROIDERY)

Kinnder offers embroidery personalisation services on selected products.

By purchasing a personalised item, you acknowledge and accept the following:

Embroidery Size & Placement

  • Embroidery letter/name height is determined by the length of the name and is a maximum of approximately 9cm.

  • There is no guarantee that multiple items will have identical embroidery sizing or placement.

  • Bag patterns may not be perfectly straight, meaning embroidery may not align with the bag pattern.

  • All care is taken to ensure straight embroidery, however a small margin of error is considered acceptable.

Customer Responsibility

  • Customers are fully responsible for the spelling, wording, and details entered at checkout.

  • Kinnder is not liable for errors made by the customer at the time of ordering.

Preview

  • Customers may request a preview on the product page prior to purchase.

  • Previews are optional and are not automatically provided with every order.

Font Changes

  • Kinnder may update embroidery fonts from time to time. Orders placed prior to font updates may not match new font styles.

Final Sale

  • Personalised products are final sale and cannot be returned for change of mind.

  • Personalised products can only be refunded or replaced if the item is faulty or if Kinnder has made an error in spelling or colour.

No Changes or Cancellations

Once an embroidery order has been placed, it cannot be cancelled, edited, or amended.

8. ORDER CONFIRMATION

All orders are considered accepted once you receive an order confirmation email.

You may wish to print or save this confirmation for your records.

We reserve the right to cancel or refuse any order at our discretion, including due to:

  • suspected fraud;

  • incorrect pricing;

  • stock availability issues.

9. PRICING ERRORS

We make every effort to ensure prices listed on our Website are accurate. However, in the event of a pricing error, Kinnder reserves the right to cancel or refuse any affected order and provide a full refund.

10. PAYMENT

All prices are displayed in Australian Dollars (AUD) and include GST where applicable. Shipping costs are calculated at checkout.

We accept payment via:

  • Visa

  • MasterCard

  • PayPal

  • Afterpay

  • Other payment methods displayed at checkout

Payment will be processed at the time your order is placed.

11. PROMO CODES

Promo codes are valid for a limited time only. Kinnder reserves the right to modify, cancel or withdraw promo codes at any time.

Promo codes:

  • apply to qualifying items only;

  • cannot be applied to previously placed orders;

  • do not apply to pre-orders unless stated;

  • do not apply to gift cards unless stated;

  • do not apply to items listed in the sale section unless stated;

  • are not transferable and cannot be redeemed for cash;

  • cannot be combined with other promo codes unless stated;

  • only one promo code may be used per order.

12. SHIPPING

Kinnder ships worldwide.

Dispatch Timeframes

Orders are typically dispatched within 1–3 business days.

Personalised (embroidered) orders are typically completed and dispatched within 1–3 business days, however this timeframe is subject to change during peak periods or due to operational demands.

Split Shipping

If your order contains pre-order and in-stock items, all items will be shipped together once the final item becomes available.

If you wish to have in-stock items shipped earlier, you must contact us at hello@kinnder.com.au and additional shipping fees may apply.

Authority to Leave (ATL)

All parcels are sent with Authority to Leave (ATL) unless otherwise specified.

Once a parcel is marked as delivered by the courier, Kinnder is not responsible for loss, theft, or damage occurring after delivery.

13. MISSING OR LOST PARCELS

If your parcel is missing, you must lodge a missing parcel enquiry with Australia Post (or relevant courier).

Kinnder will only be able to offer a replacement or resolution once:

  • the courier has declared the parcel missing, OR

  • the courier is unable to provide evidence of delivery.

We do not replace parcels until the above process has been completed.

14. CANCELLATIONS & ORDER EDITS

Cancellations (Prior to Fulfilment)

If you wish to cancel your order prior to fulfilment or personalisation, you may request a refund. A 10% restocking/admin fee will be deducted to cover administration and transaction fees.

If you request store credit instead of a refund, the restocking/admin fee will not apply.

Please email hello@kinnder.com.au as soon as possible to request a cancellation. Orders may be fulfilled quickly, and cancellation is not guaranteed.

Editing Your Order

If you need to edit your order, please contact us immediately at hello@kinnder.com.au.

Changes are not guaranteed. If your order ships according to the original order details, this is not considered an incorrect order.

In this situation, Kinnder is not liable and our Change of Mind Return Policy will apply.

Personalised Orders

Changes, edits, cancellations or amendments to personalised (embroidered) orders are not possible once an order has been placed.

15. CHANGE OF MIND RETURNS

Don’t love your order? That makes us sad, but we want you to be 100% happy.

You may return eligible items within 30 days of receiving your order for a refund or exchange, provided all of the following conditions are met:

  • Item was not part of a clearance sale, end of line, or listed in our sale section

  • Item has not been used or worn

  • Item is not soiled or damaged

  • Item has original undamaged packaging and tags

  • Item is not personalised

Customers are responsible for all return shipping charges. Refunds will not include original shipping costs.

Restocking/Admin Fee

If you request a refund (full or partial), a 10% restocking/admin fee will apply to cover administration and transaction fees.

If you request an exchange or store credit instead, the restocking/admin fee will not apply.

Return Process

To return an item, you must complete our return form available on our Website and include it with your return parcel.

Please do not wait for a response before sending your return. The form ensures we have your details once the return arrives.

16. PERSONALISED ITEMS

Unless faulty, personalised products cannot be returned for change of mind.

17. FAULTY OR DAMAGED ITEMS ON ARRIVAL

We do our very best to check every item before dispatch, however mistakes can happen.

If your item arrives faulty or damaged, please email hello@kinnder.com.au with:

  • your order number;

  • details of the issue;

  • clear photos of the fault.

If your item is deemed faulty, you will be offered the choice of:

  • replacement, or

  • refund.

Restocking/admin fees do not apply to faulty items.

18. STORE CREDIT & GIFT CARDS

Store Credit

Store credit is valid for 12 months from the date of issue unless otherwise stated.

Prize / Promotional Store Credit

Store credit issued as a prize or promotional gift is valid for 3 months unless otherwise stated.

Gift Cards

Gift cards are valid for 3 years from the date of issue (unless otherwise required by Australian law).

Gift cards and store credit are not redeemable for cash and are non-refundable.

19. PRE-ORDERS

Kinnder pre-orders are final and no cancellation period is offered.

Please review estimated delivery timeframes before placing your order. Estimated delivery dates are a guide only and may change.

If your order contains both pre-order and in-stock items, all items will be shipped together once the final item arrives unless split shipping is requested by contacting hello@kinnder.com.au.

20. WARRANTY (2-YEAR LIMITED WARRANTY)

Effective Date: 26/09/2024

At Kinnder, we trust that your products will accompany you on many exciting adventures.

We are pleased to offer a 2-Year Limited Warranty on our backpacks, subject to the terms and conditions outlined below. This warranty applies exclusively to purchases made directly through www.kinnder.com.au.

Warranty Coverage

  • Duration: Two (2) years from the date of purchase.

  • Scope: Covers defects that render the product unusable, including:

    • hardware components;

    • external seams.

Warranty Exclusions

This warranty does not cover:

  • general wear and tear due to normal use;

  • washing issues;

  • handles breaking due to overloading or excessive weight;

  • damage caused by improper care, mould exposure, stains, or neglect;

  • any issues deemed not to be a manufacturing fault.

Claims and Resolution

Where a claim is approved, Kinnder may offer:

  • Repair for minor issues (such as broken zippers, loose stitching, bag handles coming off, detached straps);

  • Replacement for defective items.

Refunds / Credits

  • Approved claims made within 3 months of purchase may be eligible for a replacement or store credit.

  • Approved claims made after 3 months will be eligible for store credit equivalent to the cost of the item claimed.

How to Make a Claim

To submit a warranty claim, email hello@kinnder.com.au with:

  • details of the issue;

  • proof of purchase.

Important Notes

All warranty claims are subject to review and approval. Kinnder reserves the right to determine whether a claim meets the warranty requirements at our sole discretion.

21. ONLINE MEDIA RELEASE / USER CONTENT

By submitting or uploading photographs, videos, reviews, or other content to Kinnder, or by tagging Kinnder on social media, you grant Kinnder permission to use, reproduce, publish, and distribute this content for marketing and promotional purposes, including on our website, email marketing, advertisements, and social media platforms.

22. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Kinnder is not liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, goodwill or anticipated savings.

We will not be liable for delays or failure to perform obligations due to events beyond our reasonable control, including courier delays, natural disasters, supply chain disruptions, or technical failures.

Nothing in these Terms excludes any rights you may have under the Australian Consumer Law that cannot legally be excluded.

23. AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

24. CHARGEBACKS & FRAUD

Kinnder reserves the right to investigate and dispute any chargeback claims where evidence exists that an order was fulfilled, dispatched, and/or delivered.

Fraudulent chargebacks may result in Kinnder pursuing recovery of goods, costs, and associated fees.

25. GOVERNING LAW

These Terms & Conditions are governed by and construed in accordance with the laws of Queensland, Australia.

Any disputes relating to these Terms or this Website shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
